POSITION SUMMARY:

The Personal Injury Attorney plays a crucial role in advocating for our clients who have suffered injuries due to the negligence or wrongdoing of others. This position requires a compassionate yet assertive legal professional who can manage a dynamic caseload while delivering high-quality legal representation. This role is responsible for leading clients through every phase of the personal injury process from initial consultation through resolution, ensuring legal excellence, client satisfaction, and consistent communication. This role also involves collaborating closely with internal teams to strategize case management, optimize outcomes, and contribute to the overall success of the legal department.

KEY RESPONSIBILITIES:

  • Represent clients in a wide range of personal injury matters, including motor vehicle accidents, slip and falls, wrongful death, and workplace injuries.
  • Conduct initial case assessments, client interviews, and thorough investigations to determine case viability.
  • Develop legal strategies and prepare cases for litigation, settlement negotiations, or trial.
  • Draft and file legal documents, including pleadings, motions, discovery responses, and settlement agreements
  • Attend depositions, mediations, hearings, and trials as necessary.
  • Maintain clear, consistent, and compassionate communication with clients, explaining legal processes and expectations throughout the case.
  • Negotiate effectively with insurance companies, opposing counsel, and third parties to achieve favorable resolutions.
  • Collaborate with paralegals, investigators, and other support staff to ensure timely and thorough case development.
  • Maintain accurate and up-to-date case files and documentation in compliance with firm standards and legal requirements.
  • Monitor and adhere to deadlines, court dates, and procedural rules to protect client rights.
  • Track and report on case progress and outcomes to firm leadership as needed.
  • Stay informed on relevant personal injury laws, case laws, and regulatory developments.
  • Support firm initiatives and contribute to team development and process improvement efforts.

  • Strong legal research, writing, and analytical skills to develop persuasive legal arguments and documentation.

  • Proactive problem-solving abilities, sound judgment, and a strategic mindset in case development and litigation planning.
  • Effective negotiation skills and courtroom presence to advocate successfully for client interests.
  • High level of professionalism, integrity, and discretion when handling sensitive client information.

  • Strong organizational and time management skills to meet strict deadlines and procedural requirements.
  • Commitment to continuous professional development and staying current on legal practices and technology.
  • Ability to adapt quickly to changes in case strategies, client needs, or firm protocols.

MINIMUM QUALIFICATIONS:

  • Active license to practice law in the State of Montana.
  • 2+ years of experience practicing personal injury law preferred but not required for highly motivated candidates with relevant litigation experience.
  • Strong working knowledge of civil litigation procedures, court rules, and evidence standards.
  • Proficiency in Microsoft Office Suite, legal research platforms (e.g., LexisNexis or Westlaw), and case management software.
  • Must be able to read, comprehend, and produce detailed legal documents and correspondence.
  • Must hold a valid driver's license.

PHYSICAL REQUIREMENTS:

  • Prolonged periods of sitting.
  • Perform repetitive tasks such as typing and clicking.
  • Must be able to lift and move light items up to 20 pounds at times.
  • Must be able to bend, reach, push, pull, lift, and sit.
